Scope
Right of publicity — unauthorized use of voice, name, photograph, or likeness for commercial purposes, including AI-generated simulations. Secondary liability for distributors and tools whose primary purpose is unauthorized replication.
Maximum penalty
Triple damages + attorneys fees; Class A misdemeanor (up to 11 months 29 days; fines up to $2,500); injunctive relief and destruction of infringing materials.
