Texas Responsible Artificial Intelligence Governance Act (HB 149)
The Texas Responsible Artificial Intelligence Governance Act (TRAIGA, HB 149) took effect on January 1, 2026. It prohibits developing or deploying AI with the intent to engage in specified harmful practices, sets disclosure duties for governmental entities and certain health-care uses, creates a regulatory sandbox, and is enforced by the Texas Attorney General, with an opportunity to cure before enforcement.

Maximum penalty
Civil penalties per violation: $10,000 to $12,000 for curable violations; $80,000 to $200,000 for uncurable violations; $2,000 to $40,000 per day for continuing violations. State-agency monetary penalties capped at $100,000 per violation (Texas HB 149, Sec. 552.106).

- 02Consumer disclosures must be clear, conspicuous, in plain language, and must not use dark patterns
- 03Healthcare providers using AI must disclose to the patient or their representative by first service date (except emergencies)
- 04Do not develop or deploy AI intended to incite self-harm, harm to others, or criminal activity
- 05Governmental entities may not deploy AI social-scoring systems that result in detrimental treatment
- 06Governmental entities may not use AI for untargeted biometric identification via image gathering without consent
- 07Do not develop or deploy AI with sole intent to infringe constitutional rights
- 08Do not develop or deploy AI intended to unlawfully discriminate against a protected class
- 09Do not develop AI intended to produce unlawful deepfake sexual material or CSAM
