Enforcement: Illinois Department of Human Rights (IDHR); Illinois Human Rights Commission
Scope: Employers using AI in recruitment, hiring, promotion, discipline, or conditions of employment; disparate impact is sufficient (intent not required); prohibits ZIP code as proxy for protected class.
Maximum penalty: IHRA civil remedies — back pay, compensatory damages, attorneys fees, civil penalties.
